‘The Constitution has kept India united in crisis’: CJI Gawai in Allahabad High Court. Bharat News

New Delhi: India’s Chief Justice Dye Chandrachud said on Saturday that the Indian Constitution has played a decisive role in ensuring the unity and strength of the country in the time of crisis. Speaking at the inauguration of Advocate Chambers and the inauguration of a multi-level parking facility in the Allahabad High Court, CJI Br Gavai underlined the permanent relevance of the Constitution in guiding the country’s progress.“Whenever there is a crisis in the country, it has been united and strong. The credit should be given to the Constitution,” Gawai said. He said that India’s visit to development is possible after independence due to constitutional structure.Recalling the debate during the framing of the Constitution, Gawai said, “Some said that the Constitution is very federal, some said it is very unique. But Dr. BR Ambedkar clarified that it is neither completely federal nor unique, but one that will keep India united and will be strong in both peace and war.”He said that the legislature, executive and judiciary have collectively contributed to bring social and economic equality in 75 years since the implementation of the Constitution. “It is our fundamental duty to reach the last citizen who needs justice,” he said.Referring to the major legal developments, Gawai highlighted the Supreme Court’s decision of the 1973, while the verdict was ruled that while Parliament could amend the fundamental rights, it cannot change the infrastructure of the Constitution. “Fundamental Rights and Instructions Theory is the two wheels of the Golden Rath of the Constitution,” he said.Appreciating the Allahabad High Court for its role in judicial progress, Gawai praised the judges who vacated 12 bungalows to make way for the new lawyer chambers. He said, “Bar and bench are two sides of the same coin. The chariot of justice cannot move forward until the two work together,” they said.
