New Delhi: Chief Justice Sanjeev Khanna is understood to have recommended the Center to start a resolution in Parliament. Allahabad High Court‘S Justice Yashwant VermaWho refused to resign on March 14, despite confirming a huge amount of cash at his official residence in Delhi.The SC officially said on Thursday that the CJI wrote to President Drupadi Murmu and PM Modi as per the in-house process, “Appealing from Justice Verma on 6 May with a letter/response on May 3-to attach a copy of the three-member committee report on 3 May”.Under the in-house process, if an inquiry report motivates the judge to corruption or rape, the CJI would ask the concerned judge to either resign or seek voluntary retirement. If the judge refuses, CJI has to write to the President and PM to start the removal proceedings. Judge Inquiry Act,On the recommendation of the CJI, the government will have to start a proposal to remove Nyaya Verma in either the Lok Sabha (a minimum of 150 MPs) or the Rajya Sabha (50 MPs to sign). This will then be open to the LS Speaker or RS President to decide whether the proposal is to be accepted.Once the proposal is accepted, the speaker or chairman will form a three -member committee, including an SC judge and HC Chief Justice and a reputed jurist. The committee will make allegations against the judge for investigation and the concerned judge will have an opportunity to deny evidence.Justice Verma is without judicial work from March 2 After a formal test, the committee will submit a report to the concerned House, which if it finds guilty to the judge, will debate the case in two houses. The judge can be presented with two-thirds of the members only after each House and supports the voting proposal. Earlier, Parliament had debated the movements against SC Judge V Ramaswamy, which fell in the Lok Sabha in 1991 and Calcutta HC’s Justice Soumitra Sen, who resigned from the midway through debate in Parliament. In its May 3 report, investigation panel including Punjab and Haryana HC Chief Justice Sheel Nagu, Himachal Pradesh CJ GS Sandhwalia and Justice Anu Shivraman of Karnataka HC found out that a huge amount of cash was found at Justice Verma’s residence at Justice Verma’s residence.The inquiry panel also expanded the mysterious disappearance of the cash bundles, which did not set fire on the night of 14–15 March, when the respondents and the police left the spot.
