New Delhi: A day later, a day after Tamil Nadu questioned the decision to suspend DGP HM Jairam, a day after a youth was investigated for his role in alleged kidnapping, the Supreme Court on Thursday watched MK Stalin Gavat’s administrative move well in all-India service rules, which controls IPS officers.On behalf of TN, senior advocate Siddharth Dave told a bench of Justice Ujjal Bhuyan and Manmohan that Jairam’s suspension was not affected by the order of Madras HC, in which he was arrested for arresting him in the alleged kidnapping case, in which his vehicle was used to remove the teenager after working with a woman from his house.Dave said AIS empowers a state government to keep an IAS or IPS officer under suspension if it is facing a test or test in a criminal case. He said, “We did not want to give the realization that the law would be implemented in a different way for high-ranked officers. Once the investigation is completed, and based on its result, a decision will be taken whether to continue suspension or cancel it,” he said.When the bench is naked, Dave gave instructions from the state government and told the court that TN would have no objection if the investigation of the case is transferred from the local police to CB-CID. The bench also ordered the CB-CID for transfer of investigation.While on the HC order for action against Jairam, the bench said that although the suspension would not intervene in the order, it was open to challenge its validity in a suitable platform for the IPS officer. It also requested the Chief Justice of Madras HC that he had passed the hearing of cases related to the kidnapping incident to a judge, among others who had passed an order for action against Jairam.On Monday, HC Justice P Velmurugan directed the police to arrest Jairam, stating that “a strong message should go publicly that no one is above the law”. The order was passed during the hearing of an anticipatory bail argument by MLA KV Kuppam, who is also an accused in the case. HC refused to give relief to the MLA and ordered him to cooperate in the investigation into the kidnapping case.
