Krishna Janmabhumi Ro: Allahabad HC says the royal Idgah ‘not disputed’; Argument dismissed | Bharat News

New Delhi: The Allahabad High Court has dismissed a petition by the Management Committee, Shahi Jama Masjid, which demanded to declare the Shahi Idgah Mosque in Sambhal as a disputed structure. The committee challenged an earlier order by a local Sambhal court that allowed a survey of the mosque complex, but the High Court upheld the validity of both the suits and the order to appoint the commissioner of the court.Justice Rohit Ranjan Aggarwal ruled that the suit was not replaced by the places of worship (special provisions) Act, 1991, stating that the plaintiff was demanding access to a protected monument under only 1958 ancient monuments and archaeological sites, rather than trying to change the religious character of the site.The suit was filed by lawyer Hari Shankar Jain and others, claiming that the Shahi Idgah Mosque was built by Mughal Emperor Babur after demolishing the Harihar temple in 1526. The plaintiff argued for the right to reach the site located in Mohalla Kot Purvi, Sambhal.The High Court rejected the amendment petition, stating, “The amendment fails and rejected by it. The interim order is empty. The suit to move forward.”Lawyers from both sides admitted that the ruling legal process was followed. Hindu side lawyer Mr. Gopal Sharma welcomed the verdict, while Muslim side advocate Shakeel Ahmed Warsi said that it reflects the appropriate process.
