Ahmedabad: Private firm employee, Sureshchandra, his wife Varsha Shukla and his son Vikrant will get their Provident Fund (PF) after a long legal battle of about 21 years after the death of 15 years.Sureshchandra’s second wife, Hinanani and daughter Vilaspati objected to Varsha’s PF claim. Last week, the City Civil Court gave the succession certificate to Varsha and Varsha, stating that the PF amount of the deceased employee should be given more than Rs 10 lakh.Sureshchandra died in May 2004 without a will. In January 2009, Varsha received a letter from the EPFO commissioner, in which he was informed that Hinarni claimed Sureshchandra’s PF amount as his widow. When Varsha objected, the EPFO insisted that she receives a succession certificate. In 2010, a civilian court of the city ordered a certificate to be issued in his name.Hirani and Vilaspati shifted Gujarat HC in 2016, claiming that they were a legitimate successor to Sureshchandra. He argued that Varsha and Vikrant had suppressed the details about pending litigation in UP, and had incorrectly obtained a succession certificate. In 2017, HC abolished the succession certificate and directed the City Civil Court to decide the issue after hearing both sides. Over time, the luxury remained the only objection to Varsha and Vikrant’s claim. In 2022, the court was told that Vilaspati had died and had no heir. The court then allowed the application of Varsha and Wirent, in which it was ordered to pay PF amount with earned interest.
