New Delhi: The SC on Monday refused to entertain a petition filed by the Samajwadi Party (SP), in which a Pilibhit municipality -owned building was questioned by the party’s eviction, and said that when a governing political party has misused its powers to allocate the buildings illegally, it is not in power.Separating the enthusiastic arguments of senior advocate Siddharth Dave, Justice Surya Kant and Joylya Bagchi said, “If you (party) misuse and misuse their powers to allocate the municipal buildings, it cannot complain when the allocation is not canceled when it is not canceled.” Refusing to give time to the SP to vacate the campus, SC said, “You do not remember the law when you are in a position to misuse your power. Or, how do you get a major municipal bungalow for 150 monthly rent? We will not interfere with Allahabad HC order. The people of the country should feel that there is a law of law which applies equally to all including political parties. ,The office premises were allocated to the SP in March 2005 at a monthly rent of Rs 150 at a prominent place in civil lines near Nakatadhana Square in Pilibat. After more than 20 years, the municipality sent a removal notice to the SP on 6 June, and four days later, came with the police force to evict the party. However, after an undertaking by the SP District President, it was trusted that the campus would be vacant by 16 June. On 18 June, the municipality asked the party to vacate in three days. Officials closed the campus on 23 June. The challenge of eviction before rejecting HC on 2 July.
