Mumbai: In the 1,036-Page verdict in the Malegaon blast case, the judge qualified in the allegations that the anti-terrorism squad (ATS) had tortured the witnesses and imposed evidence. While the court rejected the claims of torture from now on- accused Pragya Pragya Thakur and Lieutenant Colonel Prasad Purohit, it considered the claims of illegal custody of accused Sameer Kulkarni to be reliable. These conclusions against the agency resulting in the 11/7 train blasts case in the case of Bombay High Court. In the July 21 decision, HC abandoned the evidence used to capture 12 men for nearly two decades. HC also expressed serious doubts about the integrity of the ATS investigation methods. It was believed that the statements of the accused were the result of custodial torture. The court used the allegedly used brutal methods allegedly used by the police to extract confession, in which individuals were forced to divide their feet 180 degrees, tie people on a chair all night, refusing them for a long time, denying them for a long time, by cooking in the underwear and cooking in the mice, with a serious beating.HC said, “A person does not allow a person to sleep, so that he stands with his arms tied over his head all night, or draws his legs up to 180 degrees, as the accused is repeatedly testified, the body will not leave visible marks, whether it may injure the mind or mentally injured.”In the Malegaon case, 39 out of 323, who were fought by their statements from the statements made to the ATS, also made allegations of torture. The NIA judge expressed concern about the torture and methods of illegal prevention adopted by the ATS officers and questioned the credibility of the evidence collected. A witness claimed that she was forcibly taken by ATS officials in Nashik and was questioned late at night. He alleged that the authorities threatened him and pressurized him that to make a statement that was aligned with his story. Feeling sick and fed up with frequent calls and tremendous detens, he made a statement set by the ATS. He said that the facts are baseless in that statement and he has filed a complaint against the ATS officials with the Human Rights Commission. The judge concluded, “Thus, the probability cannot be dismissed that his statement was recorded by Brobbiting and threatened to face serious consequences. The testimony of the witness shows that his statement was involuntary and tremendous. Such a statement could not be trusted.”The verdict also called for an investigation into the works of ATS officer Shekhar Bagde, under whose suspicious circumstances the attendance was noted in the house of an accused. The accused, Sudhakar Chaturvedi, was acquitted on charges of collecting the bomb. The judge said, “RDX remains which were found to be bent towards planting. Two army officials testified that they had seen … a bag in the house under suspicious circumstances that kept a bag and fulfill some suspicious activities.” Similarly, in the case of train explosion, HC visited the importance of real justice. “But creating a wrong presence of resolving a case that the accused has been brought to justice, it gives a misleading feeling.”
