New Delhi: Kolkata Police, while defending the arrest of Instagram influential person Sharmisha Panoli, said that legal action was not taken for her political views but allegedly to share a video that insulted religious beliefs and promoted communal disagreement.In a detailed statement posted on X, the Kolkata Police dismissed the online situations that panoli was targeted to express nationalist sentiments. The statement said, “Some social media accounts are spreading false information that the Kolkata Police has illegally arrested a law student to oppose Pakistan. The story is mischievous and misleading.”The case against Panoli was registered at the Garden Reach Police Station on 15 May. According to the police, the video in question was “considered to insult the religious belief of a class of a citizen of India and to promote disagreement and hatred among various communities.” Police said they had worked under the relevant sections of the newly implemented Indian Joint Code (BNS).Repeated efforts to serve the legal notice to Panoli reportedly failed, police said she was “absconding”. Kolkata police said, “Several efforts were made to notice the BNS’s U/S35 to the accused, but each time he was found absconding,” said Kolkata Police. A court then issued a warrant for his arrest. He was caught from Gurugram, Haryana during the day of the day and was later presented to a magistrate, who provided transit remand. He was eventually sent to judicial custody.“A indecent language targeting any religious person or community or citizens of India, which has the ability to incite disagree and hatred among different communities, is a punishable offense … Police said that abusive language and derogatory language should not be considered wrong as freedom of speech and expression as it lies in Article 19 (1) (A) of the Constitution.The video was removed by Paanoli, a 22 -year -old law student from Pune and a public apology was released on 15 May. His arrest on Friday night began political dispute and public debate. Actress and BJP MP Kangana Ranaut called the move highly and said, “She should be released soon as she is a very young woman. Her whole career and life is ahead of her.”BJP’s Amit Malviya also criticized the arrest, accused the state government of “politics of appeasement” and questioned why no action was taken against Chief Minister Mamata Banerjee for her allegedly divisive comments.
