First challenge for courthouse arrest: Family fights us immigration with a sick child; Case accuses of violation of rights

In the case of their kind of children involving children, a Honduran mother and her two young children have filed a lawsuit against the US government on their arrest outside a courtyard in Texas alleging violating constitutional rights. According to news agency AP, the family, who legally entered the US using the CBP One app, was detained and fighting for release at the Dili Immigration Processing Center.Filed in Texas, the lawsuit argues that his arrest violated the fifth amendment of the fourth amendment against illegal discoveries and seizures and a guarantee of the fifth amendment of the fixed process. According to his legal team led by Professor Ellora Mukherjee of Columbia Law School, the family fully complied with immigration processes before taking into custody.The mother and her children fled from Honduras after threats of death in October 2024. After being parked in the US by the Homeland Security Department, he was scheduled to appear before an immigration court at Los Angeles on 29 May. But immediately after the judge dismissed his case, ice agents reportedly arrested him outside the court, arresting him in a fast-track exile. His lawyers argue that the arrest was painful, especially for a 6 -year -old boy, a leukemia patient who missed a significant investigation due to detention. Mukherjee said, “He is yellow, hurting, and suffering from bone pain.”Although their appeal is pending, the family can be deported on any day. Advocates say that the case highlights increasing concerns about the continuity of aggressive immigration enforcement of Trump administration, especially in the courtyard.“The family followed every rule,” said Kate Gibson Kumar, a lawyer for the Texas Civil Rights Project. “With young children, there should be security.”The Homeland Security Department has not commented. The government has till 1 July to respond to the trial.
