The judge said, “The victim could not identify the wrongdoers, but, eagerly, the IO did not try to face any test identity parade for the accused persons for their identity.”The judge also said that the survivor has testified in-camera to a judicial magistrate, his statement under the 164 CRPC was not produced in the court. In addition, the Emrapp Street Officer-in-charge did not bother to “signature or support” the girl’s statement, stating that she was a gang rape, which led to an FIR.The trial court also could not rely completely on the testimony of the survivor as he filed a formal application for not proceeding with him.The judge, in his order, recorded that the survivor “firmly stated that due to the passage of more than 20 years, she could not really remember what happened to her. She also failed to disclose the identity of the accused, nor could she identify the accused persons “.According to the details of the case, the survivors were engaged to work in a construction house in Rajarhat by one of the accused as an accidental laborer. According to the FIR, which was filed on May 13, 2003 in the police charge sheet filed in 2004, she was working when she was gang -raped by two persons, including her for work. 20 years ago, the police conducted a medical investigation to the victim, recorded their statement before a magistrate, and charged four people.Two of the people named in the charge sheet were arrested, while the remaining two are still absconding.
