The US government wants the exile of Indian National Badar Khan Suri to move; Judge pushes back

The US government on Thursday asked a federal judge to move the exile case of Indian National Badar Khan Suri from Virginia to Texas, where it is currently being held on charges of “spreading Hamas Publicity”.
Associated Press reported that at the hearing, US District Judge Petricia Toliver Gills expressed doubts about the government’s plea, which would require it to dismiss the Virginia case, the Associated Press said.
He emphasized that the dismissal invalidated his march instruction to keep Badar Khan Suri within the US during his first amendment proceedings.
Attorney David Bayerley of the Department of Justice indicated that he would consult about the concerns of the judge with American immigrants and customs enforcement. He expressed confidence that Ice Texas would honor his order to remain exile while transferring to the Texas Federal Court.
“Well,” the judge replied. “I am not going to trust him. But thanks,” he said.
In a court filing ahead of the hearing, American lawyers argued that Badar Khan Suri’s case should have been filed in Texas, not in Virginia, because he was already taken out of the kingdom. He called the transfer a “straight” legal case.
The Trump administration said it shifted Khan Suri to Louisiana from a detention center in Farmwal, Virginia and then to Texas due to congestion.
However, Judge Giles appeared suspicious about that explanation. He told the government that to provide specific data on how many beds were available in the farming at the time of Suri’s arrest and how many detainees have been really transferred to congestion.
The lawyers of Khan Suri of the American Civil Liberty Union told the judge that he had initially slept on the floor in a crowded Texas facility for several weeks, although he now occupies a personal cell.
His legal representatives suggested transfer to Texas with the aim of securing a more conservative judicial hearing. The Attorney Vishal Agrahark accused the government of engaging in “forum shopping”.
The federal courts in Texas and Western Louisiana have mainly opposed to the American district court of Republican, Alexandria, Virginia.

An Indian citizen, Badar Khan Suri came to the US on J -1 visa in 2022 and serves as a visiting scholar and postdotoral fellow at the University of Georgetown.
He and his wife Saleh have three children- a 9-year-old son and 5-year-old twins. Suri, who has a PhD in the studies of peace and struggle from Jamia Millia Islamia in New Delhi. Khan Suri sued the masked soon after being masked, by plainclothing agents on March 17 outside his apartment complex in Arlington, Virginia.
He is currently a Fellow in Alvalid bin Talal Center for Muslim-Christian Understanding in Georgetown.
