SC: A small application of mind by HCS will curb such litigation
The bench said that the problem of not following the law well set up across the country was prevalent and said that a little application of mind by HCS would go a long way to curb such litigation.While appearing against the couple, the state government questioned their conduct, as they were on the run. However, the bench said that it could be due to fear of police.The bench also rejected the government prosecutor’s stand before HC, saying that if the couple was granted bail, it would not be possible to recover the money. “According to the state, the police machinery needs to join the recovery of money. Why do you want the police to join for recovery of money – to squeeze the remaining amount for the seller?” It asked the advocate present for the state.
