New Delhi: Supreme Court dismisses petition challenging on Tuesday Allahabad High CourtStool Jama Masjid In Sambhal In.
The SC Bench consisted of India’s Chief Justice Sanjeev Khanna and Justice Sanjay Kumar. Petition also challenged the High Court order Archaeological survey of india (ASI) for recovery of expenses from the Masjid Committee. The argument argued that HC had erased the law by accepting this permission.
In its march judgment, the High Court directed the ASI to complete the whitewashing work on the outskirts of the Sambhal Jama Masjid, where the flaking was observed and the restoration was considered necessary.
“This will prejudice the right to be a devotee of the petitioner, which is a devotee to claim the disputed structure in the form of Hari every temple of Lord Kalki. Therefore, the petitioner has given priority to the immediate petition before this court which raises the question of law of public importance,” said the Dalil.
He further asked, “Is ASI not given funds to maintain monuments such as Hari every temple, sambhal, or dispute structure, which has been occupied by a committee of illegal mosque, Sambhal management.”
HC had allowed whitewash, saying, “ASI will complete the whitewashing work and will complete within a week of a week. Also, no additional lighting will be made on the walls, as it can damage the monuments, but the focus light/LED light can be used by ASI’s outer area.”
This directive came in view of the survey ordered by a court of the Mughal-program, which triggered violence in Sambhal last year.
