Scrap H -1B visa exception: Republican universities introduce new bills to give priority to Americans, eliminate ‘backdoor hiring’
Amidst the aspirations against the H -1B visa program, a new Republican proposal was introduced by Rape Tom Tiffany and Rape Andrew Clide, which proposes to scrap the H -1B visa exception for higher education employees. Currently, there are 65,000 -individual hats for H -1B visas and an additional 20,000 persons for the master’s degree and beyond. The colleges for the “American People’s Act of 2025” will repeal this additional exception and have those from other countries who are demanding to work in higher education, undergoing the general H -1B visa process.Tiffany said in a statement, “American students earn degrees for years, only universities look at good paying jobs to foreign workers on special visas.” “The CAP Act ensures our institutions to invest in those who are meant to serve and eliminate the recruitment practices of the back door reducing American workers.”The proposal will not be retrospective, so the current H -1B visa holders in universities can still apply for their expansion without moving to the border.For the financial year 2026, US citizenship and immigration services received adequate petitions for H -1B visa cap like last week.The proposal comes when the DHS is planning to overhall the H -1B system and replace the lottery with wages -based selection. The H-1B Trump remained a controversial issue for the administration, as before the inauguration of January, he disputed the visa program. During its last term, DHS issued a rule for Aadhaar selection in H -1B petitions on the wages presented for a post. But the rule was given shelter by the Biden administration.
H1-B process explained
H -1B is mostly used by Silicon Valley companies, but also by higher education institutions. The American employer first provides jobs to a foreign worker, then a labor status application with the Labor Department, which agrees to pay the prevailing wages. The employer presents the basic details of the person whom he hired during the registration window. USCIS runs a random lottery to choose because it receives far more registration than its hat. If selected in lottery, employer files form I-129 with USCIS.
