US judge stopped the release of Abrego Garcia, citing delay on snow exile concerns

A federal judge has delayed the release of Kilmar Abrego Garcia, a Salvadoron National accused in human trafficking, amidst fear from his legal team that the US immigration officer can deport it before the test. US Magistrate Judge Barbara Holmes ruled on 22 June that the Abrego Garcia did not have a risk or threat to the community, and approved his release on terms – in which he lives with his American citizen brother in Maryland. However, the defense lawyers stopped the release after raising an alarm on conflicting statements about their immigration status from the Trump administration. In court filing, the lawyers of Abrego Garcia said that he had “no confidence” in government assurance that he would not be deported citing contradictions. Justice Department spokesman Chad Gilamartin told the Associated Press that Abrego Garcia would be tried before any exile. But a few hours ago, another DOJ lawyer, Jonathan Guine, told a Judge from Maryland that the government planned to deport it to the “third country”, not Al Salvador, without any clear time. A DHS spokesperson later announced that Abrego Garcia “would never be free on American soil.” Abrego Garcia became a flashpoint in the immigration debate earlier this year, when Al Salvador was accidentally deported in March, despite the 2019 court order to protect him from removing him due to hazards from the gangs. Under increasing legal pressure, the administration returned him to the US in June. He did not convict on 13 June for smuggling from a 2022 traffic stop in Tennessi on 13 June, where he was found transporting nine passengers without goods. His lawyers have called the allegations “preceding”, accusing the government of using the charge, trying to exist before the trial to try him in the “court court of public opinion”. Acting American Attorney Rob McGire told the court that he had no right over snow, which increased further concerns about enforcement during legal proceedings. A new hearing is scheduled for 16 July, where the court will decide whether the prosecutors can cancel the earlier release order. Till then, Abrego Garcia is in federal custody in Nashville.
