New Delhi: The National Medical Commission (NMC) responding to a Parliament question on being biased towards doctors, stating that the 2002 moral regulation provided for complaints against doctors. However, the NMC’s Ethics Section is rejecting all patient appeals, claiming that the NMC Act strong on the moral regulation of the 2002.The NMC Act states that doctors can file an appeal against the decisions of the State Medical Council. Referring to this, the morality section is rejecting all the appeals filed by the patients, claiming that only doctors can file an appeal, even if it is against the law. The NMC Act itself clearly states that “the rules and regulations made under the Indian Medical Council Act, 1956 will be applicable and new standards or requirements will be operated until it is specified under this Act or under rules and regulations”.Since the regulations of the Indian Medical Council (professional conduct, etiquette and morality), it has not been replaced in 2002, it still stands. Section 8.8 of the Ethics Regulation of 2002 states: “Any person suffered from the decision of the State Medical Council on any complaint against a delicate doctor, he will have the right to file an appeal to MCI within a period of 60 days from the date of receiving the order passed by the said medical council”. Nevertheless, the appeal of more than 162 patients has been rejected by NMC.In response to Parliament, Minister of State for Health Anupriya Patel said that “to ensure that NMC works in a transparent and fair manner”, the Central Government appoints presidents and presidents of four autonomous boards as per NMC Act 2019.
